Are you not telling him to disassemble the box that has the brood in?  From his description, I envision a hive that consist of a medium (brood box) and a shallow honey super on top.  I believe he claimed that he can't get the bees to move down into the deep so there is nothing there.  Please correct me if I have this picture wrong.

You are right. The shallow honey super contains enough smells to attract them. Even an empty box that has been used has enough smell to attract them. Ten frames of honey definitely does.

I know you shouldn't make assumptions but I assume he put frames in the deep before he put the hive on top.  He might even had drawn frames or just foundation.

Update:

I checked them out this weekend.  The shallow on top still has some capped and larva (plus honey).  I examined the new deep (with built out frames) and to my surprise it was filling with honey.

That leaves the medium brood on the bottom.  I couldn't get to it and will try again this evening.  I just know it is going to crumble when I start pulling it apart.

One thing I failed to mention is that when I captured these bees the only had a top entrance through a rotted out crack in the cover.

Former beekeeper until March....maybe next year...RIP
